Welcome to Xplore. These Terms of Service govern your use of the Xplore mobile application and website provided by iQNex. By accessing or using our services, you agree to be bound by these comprehensive terms.

1. Our Role: Platform Intermediary Only

Xplore is solely a technology platform designed to connect independent travelers ("Wanderers") with independent local guides ("Travel Assistants").

• We do not provide travel services, transportation, or guided tours ourselves.
• Travel Assistants are independent contractors, not employees, agents, or representatives of Xplore or iQNex.
• Xplore does not strictly verify the safety, quality, or legality of the experiences provided by the Travel Assistants, beyond our standard background and KYC checks.

2. Strict Limitation of Liability

By using this platform, you agree that Xplore and iQNex hold ZERO liability for any events that occur during a trip.

• No Responsibility for Trip Incidents: We are not responsible or liable for any personal injury, death, property damage, accidents, theft, disputes, or any other loss or damages caused directly or indirectly during a trip facilitated through our platform.
• At Your Own Risk: You acknowledge that you use our services to meet third parties at your own sole risk. You are solely responsible for taking reasonable safety precautions.
• Disputes Between Users: Any disputes regarding payments, service quality, or behavior must be resolved directly between the Wanderer and the Travel Assistant. Xplore is not obligated to mediate or resolve disputes.

3. Fees and Payment Structure

Because Xplore is an intermediary, the financial transactions work as follows:

• Direct Cash Payments: The actual trip base cost is to be paid directly by the Wanderer to the Travel Assistant in Cash at the end of the trip. Xplore does not collect or hold these funds.
• Platform Fees for Guides: Xplore charges a fixed platform fee strictly to the Travel Assistant for facilitating the connection. This fee is automatically deducted from the Travel Assistant's in-app wallet based on our tier structure (₹49, ₹149, ₹399, or ₹799) plus applicable 18% GST.
• Bypassing the App: Any attempt to bypass the platform fee by organizing trips off-platform, while using Xplore to initially connect, will result in immediate and permanent account suspension.

4. User Responsibilities & Conduct

• You agree to use Xplore only for lawful purposes. You must not use our platform to conduct illegal activities or to harass, abuse, or harm another person.
• You agree to provide accurate, current, and complete information during registration and KYC verification.
• Wanderers are expected to meet their guides at the designated pickup location exactly at the agreed-upon time.

5. Cancellations and Penalties

• To maintain the integrity of our platform, a 5% penalty (capped at a fixed amount) is applied to either party's wallet for late, same-day cancellations or no-shows.
• Refunds of applied wallet amounts are processed automatically if a trip is cancelled well in advance without penalty.

6. Indemnification

You agree to indemnify, defend, and hold harmless iQNex, its affiliates, directors, officers, and employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Service or your use of the platform.

7. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the service (or any part thereof) with or without notice at any time. We shall not be liable to you or any third party for any modification or suspension.
